PHOREST GmbH (Commercial Register No. HRB 97059) with its registered office at Viersener Straße 10, 50733 Cologne (trading under the name PHOREST, Commercial Register No. 241896) ("Phorest", "we", "our", "us") offers a booking software service for salons, spas, barbershops, and other providers of personal services. Please read these Terms of Use carefully before using the service. This is a legally binding agreement between you, the "User", and the service provider regarding all aspects of the booking service. References to "Service Provider" or "Third Party" refer to businesses from which you book a service, such as a salon, spa, barbershop, or other type of service business.
To use this website, you must accept these Terms of Use (the “Terms”) in full and without modification, and you agree to use this website in accordance with these Terms. These Terms constitute the entire agreement between you and Phorest. If you do not read or accept these Terms, you may not use this website.

Limitation of liability
Neither Phorest nor any third party guarantees that the information on this website is error-free. By using this website, you acknowledge that you understand the information may contain errors and that we are not liable for these errors to the extent permitted by law.
All bookings for services on this website are made directly with the service provider, not with Phorest. Phorest simply facilitates the booking with the service provider. The contract is between you and the service provider, and Phorest is not a party to this agreement. Therefore, Phorest bears no direct or indirect responsibility for this contract. Before making a booking, you must ensure that you agree to the service provider's terms and conditions.
Phorest, its directors, employees, affiliates or other representatives shall not be liable for any claims, emergencies, demands, causes of action, damages, losses or expenses, including attorneys' fees and costs, in connection with the use of your personal data in accordance with this privacy policy and your consent.
Phorest strives to ensure that the listed services are of a reasonable standard; however, the listing of services on this website does not constitute a recommendation by Phorest, nor does it represent a statement that the services are suitable for the user. Phorest is not liable to you if the services are not suitable for you. Your use of the information on this website is entirely at your own risk, for which we accept no liability. Make a booking
The following terms and conditions apply to the services you have booked.
When booking third-party services through Phorest, you may be required to pay a reservation fee/deposit, which you can pay using either a credit or debit card or another payment method. Phorest uses third-party payment gateways to process this payment.
Group bookings
You can make a reservation on behalf of a group. In this case, the contractual relationship between you, the service provider, and Phorest remains with you.
Responsibility for the accuracy of information towards service providers
Services and treatments are provided by trusted third parties, who are the service providers. When making a reservation, it is your responsibility to inform the service providers directly of any physical or mental health conditions you may have that may require special accommodations.
Cancellation policy
Users may cancel bookings provided the cancellation is made before the cancellation deadline as set by the service provider at the time of booking, and reservation fees/deposits may be refunded to the card used for booking at the discretion of Phorest and the salon.
If an appointment is cancelled, a salon may, at its sole discretion, decide to retain part or all of the deposit paid, or a value up to and including the total value of the booked service.
A cancellation after the cancellation deadline will result in the loss of the reservation fee/deposit. The amount lost depends on the total cost of your booking but will not exceed the originally charged amount. If the service provider unilaterally cancels the entire booking, the reservation fee/deposit can be refunded to the card used for the booking. If the service provider only partially cancels a booking, your reservation fee/deposit remains unchanged.
Should an appointment not be cancelled before the applicable cancellation deadline, the salon reserves the right to charge the user the remaining amount of the appointment costs (i.e., the payment due at the salon, which corresponds to the total cost of the appointment less the reservation fee/deposit paid).
If you fail to appear at the agreed appointment, you authorize the service provider to charge your credit or debit card or other payment method without further notice to you for an amount equal to or less than the total booking value (less any reservation fee/deposit) or for an amount that may be specified in the service provider's terms and conditions.
In the case of group bookings, you authorize the service provider, in the event that part of your group does not appear at the agreed time, to charge your credit or debit card or other payment method an amount equal to the booking value for the persons who did not appear on time (less reservation fee/deposit) or less, or an amount specified in the service provider's terms and conditions.
Phorest accepts no responsibility for cancellations made by the user or the service provider, regardless of the circumstances under which the cancellation occurs. Phorest is not liable for any losses, additional costs, or claims of any kind resulting from changes to salon services, illness, weather, strikes, or other causes. All such losses, additional costs, or claims are your responsibility unless otherwise agreed between you and the service provider.
After a reservation has been confirmed
Phorest is not responsible for cancellations made by the user or the service provider. Phorest is not liable for any losses, additional costs, or claims of any kind resulting from changes to salon services, illness, weather, strikes, or other causes. All losses, additional charges, or claims are your responsibility unless otherwise agreed between you and the service provider.
Gift vouchers
- Purchased gift vouchers can only be redeemed in the store(s) where they were purchased.
- Gift vouchers can be partially redeemed and the remaining amount can be used at a later date, but still before the expiry date.
- Gift vouchers can be redeemed together with cash and/or other accepted payment methods.
- Please note that gift vouchers are subject to legal restrictions in several countries, which are generally structured to allow consumers to use their gift vouchers for prescribed and extended periods after purchase. Your service provider may also offer additional protection regarding the voucher's validity or an agreed period during which no legal limit applies. Please check if your voucher has an expiry date or contact your service provider for further information.
- In the case of payment by credit card or other accepted payment methods, the contract is concluded upon the customer's payment instruction.
- The voucher will be sent directly to the recipient's specified email address in a printable or presentable format after payment has been completed. This format includes details of the voucher amount, the voucher ID, an optional personal message, a barcode, the validity period, and contact details of the service provider where it can be redeemed.
- Gift vouchers cannot be exchanged for cash.
Stored payment methods
General
You agree and acknowledge that Phorest may collect, use and transfer (as defined below) any payment instruments you provide to Phorest in accordance with these terms and conditions.
The means of payment stored by Phorest is the digital data storage device used by Phorest to store means of payment (as defined below).
Data collection
Phorest collects payment details (including, but not limited to, details of a bank account, credit card, debit card, or email address associated with a payment account) (Means of Payment) from you when you make a payment to a payment option accepted by Phorest (including by telephone, online, PayPal, under an SMS pay arrangement or direct debit agreement, or such other payment option as may be approved by Phorest from time to time) or request a refund (Payment Option).
You agree that payment methods you provide to Phorest will be available for Phorest's use in accordance with your authorization and the privacy policy, among others.
Secure storage of payment methods
The respective payment method (in the case of credit and debit card data in the form of tokens) and the payment option (including any direct debit authorization) used to make a payment to Phorest are stored by Phorest or its payment partners (stored payment methods).
All stored payment methods are kept securely by Phorest or its partners and, where necessary, stored by Phorest or its payment partners in accordance with the requirements of the Payment Card Industry Data Security Standard (PCI DSS) information security standards and otherwise as required by law.
Use of stored payment methods
Stored payment methods can be used by Phorest and you to make payments to Phorest for products and services offered by Phorest, using the payment option you have authorized. No payments will be processed without your authorization.
Phorest will continue to use your stored payment methods for payments authorized by you until you notify us of a change to the stored payment methods or your payment agreement with Phorest is terminated in accordance with the applicable terms and conditions.
If your payment method is a credit or debit card, you authorize Phorest to request payments from your specified card account using your current card until it is replaced. If your credit or debit card has expired, you must notify Phorest of your new details at least three business days before the next payment.
Phorest reserves the right to charge a payment processing fee for the use of a particular payment option. Bank fees and government taxes may also apply.
Credits and refunds to you from Phorest can be made using your saved payment methods.
Your saved payment information, including details of your current payment options, may also be used in connection with Phorest products and services that we offer you.
Disclosure of stored payment methods
The stored payment methods will not be passed on to third parties, except in accordance with these terms and conditions.
Stored payment methods used for a payment, credit, or refund are shared by Phorest with relevant financial institutions and payment service providers for the following purposes: enabling the payment, credit, or refund; and complying with the PCI DSS information security standard requirements.
Stored payment information may be shared with individuals and organizations that support Phorest in its business operations, such as payment service providers, professional advisors, IT support, and business and administrative services, including credit bureaus (e.g., debt collection agencies) and debt buyers. We only do this when sharing the information is necessary for these services to be provided to Phorest.
Phorest may also share stored payment methods to comply with applicable legal regulations, including but not limited to data protection laws.
Verification of payment methods
You agree to provide Phorest information upon request, including but not limited to certified identification documents, bank statements, and other documents, so that Phorest is able to:
- To verify (or further verify) your identity.
- To verify information related to a bank account that is being used for a payment.
- To verify information related to a payment option other than a bank account being used for a payment.
- To verify the origin of a payment to Phorest.
Phorest can directly verify with financial institutions and payment service providers that the payment option you used and the payment methods you provided are valid and correct. Until Phorest has verified that the verification information provided is true, correct, and complete, refunds are at Phorest's discretion if Phorest considers (or believes likely) a payment to be unauthorized or made by someone other than you.
Phorest may, at its sole discretion, refuse to accept any payment using a payment option, particularly in circumstances where the respective payment option has been rejected in connection with a previous payment.
Changing or removing saved payment methods
You can change or remove your saved payment methods at any time. If you wish to change or remove your saved payment methods, you must notify Phorest by contacting the customer service team or using another method that Phorest may provide. Future payments still pending using your saved payment method may be canceled if the saved payment method is removed.
Reviews
After completing an appointment with a service provider, you may receive an email asking if you would like to leave a review. If you choose to leave a review, the information will be forwarded to the service provider and Phorest. This information will be stored securely. By leaving a review, you agree to its publication by Phorest or the service provider. Should Phorest or the service provider decide to publish your review, only your first name will be displayed. The service provider and Phorest are not responsible for any wording you may use in the review that could reveal your identity.
General
These terms and conditions and your use of this website are governed by the laws of the Republic of Ireland. You hereby submit to the exclusive jurisdiction of the courts of the Republic of Ireland for any disputes arising out of or in connection with your use of this website each time you access it. Use of this website is permitted only in jurisdictions that give legal effect to all provisions of these terms and conditions, in particular this paragraph.

General terms and conditions for the loyalty program
These terms and conditions govern your participation in any loyalty program offered through the Phorest app (hereinafter referred to as the "App") by the hair salon, beauty salon, medical aesthetics salon, or spa (hereinafter referred to as the "Salon") you have chosen. By registering for and participating in the loyalty program, you agree to these terms and conditions. Please read them carefully.
Eligibility and conditions
- Participation in the loyalty program is generally open to all customers of the salon who have registered in the app. The salon reserves the right to verify eligibility on a case-by-case basis.
- Only one loyalty program account is allowed per person.
- The salon may refuse participation if the requirements are not met or these conditions are violated.
- You are responsible for ensuring that your information is correct and up-to-date during registration.
Collect points
- Points can be collected as part of the loyalty program through qualifying purchases of services and/or products in the salon.
- Further opportunities to collect points can be defined and communicated by the salon, e.g. for recommendations, follow-up appointment bookings or interactions on social media.
- The exact method of collecting points (e.g., through specific amounts, bonus promotions, etc.) will be determined by the salon and communicated to you via the app or other communication channels.
- Certain purchases or services may be excluded from the points award – this is determined by the salon.
Redeem rewards
- Collected points can be redeemed for discounts, free services, products, or other benefits offered by the salon.
- The number of points required for each reward is determined by the salon and communicated via the app or other channels.
- Redemption may be subject to certain restrictions – for example, a maximum number of points redeemable per visit or exclusions of specific services or products. These rules are determined by the salon and will be communicated to you.
- Points have no monetary value and cannot be converted into cash. They are non-transferable.
Changes and termination of the program
- The salon reserves the right to modify, pause, or terminate the loyalty program at any time – with or without prior notice. This includes changes to redemption terms, rewards, or eligibility requirements.
- Significant changes may be communicated to you via the app or other channels.
- Your continued participation in the loyalty program after changes will be considered your acceptance of the updated terms and conditions.
- The salon is entitled to terminate your participation in the loyalty program if you violate these terms and conditions, exhibit fraudulent behavior, or misuse the program.
- Any points you may have but have not been redeemed may expire upon termination of your participation or discontinuation of the loyalty program.
Points depreciation
- Collected points may expire. The rules regarding this (e.g., expiry after a certain period of time or inactivity) are determined and communicated by the salon.
- The salon can remind you of upcoming point expiration. However, it is your responsibility to be aware of and adhere to these deadlines.
- Expired points cannot be refunded or redeemed.
Data protection
- By participating in the loyalty program, you agree to the collection, processing and use of your personal data by the salon in accordance with applicable data protection laws and the salon's privacy policy.
- The data collected may include, in particular, your name, contact details, purchase history, and other information relevant to the loyalty program.
- The collected data will be used to administer the program, provide rewards, personalize your user experience, and communicate about the program and salon offers.
- Within the framework of legal regulations, you have rights regarding your personal data, in particular the right to information, rectification and erasure – in accordance with the salon's privacy policy.
General provisions
- These terms and conditions constitute the entire agreement between you and the salon regarding the loyalty program.
- The loyalty program is offered by the salon; Phorest merely provides the technical platform (the app). Phorest is not responsible for the organization or administration of the loyalty program.
- The salon's decisions regarding the loyalty program are final and binding.
- These terms and conditions are subject to the law of the country in which the salon is located.
By participating in the loyalty program, you confirm that you have read, understood, and accepted these terms and conditions. For further information regarding your individual loyalty program—such as points allocation, available rewards, or specific regulations—please contact the relevant salon directly.
ONLINE SHOP
1. Scope of application The following terms and conditions apply to all orders placed via our online shop.
Shipment:
Shipping costs to Austria:
- Free shipping on orders over €30.
- For orders under €30, shipping costs are €5.
- For cash on delivery, an additional cash on delivery fee of €5 will be added; the total invoice amount will be collected in cash by the parcel service.
- For cancelled orders that have already been shipped, the return shipping costs will be borne by the customer!
- We only deliver within Austria!

2. Contractual Partners, Conclusion of Contract. The purchase contract is concluded with HAIRSALONS.at by Martin Hammerschmid. By placing the products in the online shop, we submit a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive an order confirmation by email immediately after submitting your order.
